These Terms & Conditions (the “Terms”) govern your access to apykidz.com (the “Site”) and every purchase you make from APYKIDZ (“APYKIDZ”, “we”, “us”). By using the Site or placing an order you agree to these Terms, our Privacy Policy, our Shipping & Returns Policy and our Cookie Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. Products for children are intended to be bought by parents, guardians and other adults.

2. Products and descriptions

We work to describe and photograph our products accurately, but colors, sizes and appearance may vary slightly because of screens, batches and manufacturing tolerances. Products are sourced from third-party suppliers. Descriptions, sizes and specifications are provided for information and are not a guarantee of fitness for a particular purpose. Product photos may show accessories or styling that are not included; check each product page.

3. Orders and acceptance

Placing an order is an offer to buy. We may accept, limit or decline any order, for example in case of stock or supplier issues, suspected fraud, pricing or listing errors, or abuse of promotions. An order is accepted when we send a shipping confirmation. If we cancel an order after payment, you will receive a full refund.

4. Prices and payment

Prices are in US dollars unless stated otherwise and exclude taxes, duties and import charges that may apply to your order and be shown at checkout. We may change prices at any time; the price at checkout when you place your order applies. If a price is clearly wrong because of an error, we may cancel the order and refund you. Payment is taken at checkout by our payment providers, and you confirm you are authorized to use the payment method you enter. Crossed-out prices show the list price before the promotion currently applied.

5. Promotions, discount codes and timed offers

Promotions and discount codes are subject to the conditions shown with the offer. Unless stated otherwise: one code per order; codes cannot be combined, exchanged for cash or resold; timed offers run for the period shown, may be shown once per browser or device, and can be withdrawn, changed or ended at any time; and we may cancel orders that abuse a promotion or use a code that was not issued to you. Discounts apply to the products in your cart at checkout, and the final price shown at checkout is what you pay.

6. Shipping, delivery and risk

Delivery times, free shipping terms and tracking are described in our Shipping & Returns Policy. Delivery dates are estimates, not guarantees. Risk of loss passes to you on delivery to the address you provided, so please enter it carefully.

7. Returns, refunds and personalized items

Returns and refunds are governed by our Shipping & Returns Policy. Personalized or custom-made items are made to your specifications and cannot be returned unless they are defective or not as ordered.

8. Product use and safety

You are responsible for choosing products that are suitable for your child’s age, weight and development, and for following the instructions and warnings included with each product. Baby and child products must be used with adult supervision. Please read our Product Safety & Disclaimer.

9. Your account and conduct

If you create an account, keep your login details confidential; you are responsible for activity under your account. You agree not to: use the Site unlawfully; interfere with or attempt to breach its security; scrape or copy it with automated tools without permission; submit false, fraudulent or harmful information; or abuse promotions, reviews, likes or support channels. We may suspend or terminate access at our discretion.

10. Reviews and user content

If you submit a review, photo, comment or other content, you confirm it is truthful, lawful and yours to share, and you grant APYKIDZ a free, worldwide, non-exclusive, perpetual license to use, reproduce, adapt and display it in connection with our business. We may remove content at our discretion.

11. Intellectual property

The Site’s content, including the APYKIDZ name and logo, text, graphics, designs and layout, is owned by or licensed to APYKIDZ and protected by intellectual property laws. You may not copy, reproduce or exploit it without our written permission, except for personal, non-commercial use. See our Intellectual Property & Copyright Policy to report an infringement.

12. Third-party services and links

The Site relies on third-party services (such as hosting, payment, shipping and analytics providers) and may link to third-party websites. We do not control them and are not responsible for their content, availability or practices.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Site and products are provided “as is” and “as available”, and we disclaim all warranties not expressly stated, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

14. Limitation of liability

To the maximum extent permitted by law, APYKIDZ and its owners, employees and partners are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Site or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence or for fraud, or your statutory consumer rights.

15. Indemnity

You agree to indemnify and hold harmless APYKIDZ from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site or products, or your violation of any law or third-party right.

16. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Before starting a formal proceeding, please contact us through our contact form so we can try to resolve the issue informally. Subject to any mandatory consumer protection rules in your country of residence, the state and federal courts located in Wyoming have exclusive jurisdiction. If you are a consumer in the EEA or UK, you keep the benefit of the mandatory laws and courts of the place where you live.

17. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, epidemics, war, strikes, carrier or customs delays, supplier shortages, and internet or service outages.

18. Changes and general terms

We may update these Terms at any time; the version published on the Site when you order applies to that order. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. These Terms, with the policies linked above, are the entire agreement between you and us about the Site and your purchases.
